Privacy Policy

  • Website Owner. 
  • Cascade Counsel PLLC, i.e., Cascade Counsel, (and herein after “Site Owner”) is the owner of this website (“CascadeCounsel.com”, hereinafter “Site”). Site Owner can be contacted by e-mail at [email protected], by phone at (425) 238-7584, or by mail at 2906 Colby Ave., Ste. 105, Everett, WA 98201. This online privacy notice discloses Site Owner’s information practices for this Site, including what types of personal identifiable information is requested to use the Site and its applications, how the information is used, and with whom the information is shared. Note that other websites and applications may be governed by privacy notices containing different information practices applicable to those sites.

  • Anonymous Website Visits. 
  • Site Owner collects certain information from Site visitors. This includes, but is not limited to, the home server domain name, e-mail address, type of computer and web browser, what pages a visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.

  • Website Transactions. 
  • At times, Site Owner will need personal information regarding a customer, client, or other Site visitor. For example, to provide a paid subscription, Site Owner may need to know a customer’s name, mailing address, e-mail address and credit card details. It is Site Owner’s intent to inform you know before collecting personal information, such as user’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Site Owner will respect your wishes.

Personal Information That May Be Collected

  • Identifying Information: 
  • To make to access designated subscriber services and /or restricted areas and services within the Site, Site Owner will request a user to provide certain personal identifying information, which may include: their legal name, postal address, e-mail address, telephone number, physical address, method of payment, and, if applicable, credit card number. Site Owner may request additional information necessary to establish and maintain customer’s account. Prospective legal clients will also be asked to provide information about their case and/or services being sought as well as information necessary to perform any necessary conflict checks.

  • Service Quality Monitoring: 
  • Some Site interactions may require a customer to telephone Site Owner, or Site Owner to call the user. Site Owner will not contact you by telephone without your prior consent, except to confirm a request placed online and/or to inform you of the status of such request. You, the Site user, should be aware that it is Site Owner’s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.

  • Information from Children: 
  • Site Owner does not sell products or offer services for purchase by children and will not collect or post information from a child under the age of sixteen (16) without the involvement of a parent or guardian. To the extent permissible under applicable Bar Rules, law, and other regulations, the Site Owner will attempt to notify the child’s parent or guardian at the e-mail address provided by the child user, alerting the parent or guardian to the child’s use of the Site and providing instructions as to how the parent or guardian can delete the child’s registration from the Site.

  • Site Owner does not use personally identifying information collected from children for marketing or promotional purposes and does not disclose such information to any third party for any purpose whatsoever.

  • Lost or Stolen Information:
  • If a user’s credit card and/or password is lost or stolen, the user should promptly notify Site Owner to enable Site Owner to cancel the lost or stolen information and to update its records with a changed credit card and/or password. Help keep your personal information accurate. If a user’s personal information has changed, please e-mail the new information to Site Owner at the e-mail address shown in Paragraph 1(a). If a user would like to review the personal information Site Owner has in its files regarding your account, e-mail your request to Site Owner.

  • Chat Rooms, Forums and Bulletin Boards:
  • If a user participates in a Site chat room, discussion forum, or posts messages to a Site bulletin board, the user should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Site Owner, who have access to that chat room, forum, or bulletin board. Some individual Site chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, any participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Site Owner.

  • Links to Other Websites:
  • Site may contain links to other websites. Site Owner is not responsible for the privacy practices or the content of those other websites.

Uses Made of the Information

  • Limited Uses Identified:
  • Without your prior consent, Site Owner will not use your personal identifiable information for any purpose other than that for which it is submitted. Site Owner uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and secure record-keeping. Site Owner also processes billing and business requests related to Site participation.

  • Marketing Uses:
  • The information you provide to the Site may also be collected, used, analyzed and/or processed by Site Owner, or selected third parties on Site Owner’s behalf, for marketing and other business purposes. Unless a user elects to opt-out, Site Owner reserves the right to provide the user with information about Site, Site Owner’s products and services, and related information in which the user has indicated an interest.

  • Stored Information Uses:
  • Site Owner stores information provided by users and/or entered on the Site. Stored information is used by Site Owner and/or Site Owner’s agents to: support user interaction with the Site; deliver services requested by users; and/or to contact users again about other services and products offered by Site Owner.

  • Online Advertising:
  • Some companies that help Site Owner deliver interactive on-line advertising, such as banner ads, may collect and use information about Site Owner’s customers, clients, and other Site users to help Site Owner better understand the types of advertising or promotions that are most appealing to these groups of people as prospective customers and/or clients. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, a user would prefer that these companies not collect such information, please opt-out where applicable.

Disclosure of the Information

  • Within Organization:
  • Site Owner is a multi-jurisdictional organization, with legal entities, affiliates, business processes, management structures, and/or technical systems that cross borders. Site Owner may share your personal information within its corporate organization, and may transfer the information to countries in the world where Site Owner conducts business. Some countries may provide less legal protection for user personal information.

  • Mergers and Acquisitions:
  • Circumstances may arise where for business reasons, Site Owner decides to sell, buy, merge, or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Site Owner’s practice to seek appropriate protection for information in these types of transactions.

  • Site Owner employs or engages other companies and individuals to perform business functions on behalf of Site Owner. These persons are provided with personal identifying information required to perform their functions but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, processing requests, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing account services.

  • Affiliated Businesses:
  • Site Owner works closely with affiliated businesses. These businesses identify themselves to users. User information related to a transaction with an affiliated business is shared with that affiliated business.

  • Marketing Analysis by Third Parties:
  • Site Owner reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.

  • Disclosure to Governmental Authorities: 
  • Under certain circumstances, certain personal information not otherwise protected by any applicable attorney-client or other privilege may be subject to disclosure pursuant to judicial or other government subpoenas, warrants or orders.

  • Mobile Information Sharing: 
  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Use of Computer Tracking Technologies

  • No Tracking of Personal Information:
  • Site is not set up to track, collect or distribute personal information not entered by visitors. Through website access logs Site Owner does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provide better services for the public. The statistics gathered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

  • Use of Cookies: 
  • Site Owner, and/or its third-party vendors, collects non-identifiable and personal information using various technologies, including “cookies”. A cookie is an alphanumeric identifier that a website, like Site, can transfer to a user’s local device through the user’s browser. The cookie is then stored on user’s computer as an anonymous tag that identifies the user’s computer, but not the user. Cookies may be sent by Site owner or its third-party vendors. A user can set their browser to notify the user before a cookie is received, giving an opportunity to decide whether to accept the cookie. Users may also set their browser to turn off cookies; however, some elements of the Site may not work properly with cookies disabled.

  • Use of Web Beacon Technologies: 
  • Site Owner may also use Web beacon or other technologies to better tailor its Site to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Site, a non-identifiable notice of that visit is generated which may be processed by Site Owner or by its suppliers. Web beacons usually work in conjunction with cookies. If a user does not want cookie information to be associated with their visits to these pages, the user can set their browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

  • Collection of Non-Identifiable Information: 
  • Site Owner may collect non-identifiable information from user visits to the Site to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Site; Site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Site Owner or its contractors may use this data to analyze trends and statistics.

  • Collection of Personal Information: 
  • Site Owner collects personal identifying information from users during a transaction or other request for services. Site Owner may extract some personally identifying information about that transaction, or other request for services, in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Site Owner understand trends and patterns. This information is not reviewed at an individual level.

Information Security

  • Commitment to Online Security:
  • Site Owner employs physical, electronic, and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints.

  • No Liability for Acts of Third Parties
  • Site Owner will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Site Owner shall not be liable for unauthorized disclosure of personal information due to no fault of Site Owner including, but not limited to, errors in transmission and unauthorized acts of Site Owner’s staff, its agents, and/or unrelated third parties.

Privacy Policy Changes and Opt-Out Rights

  • Changes to Privacy Policy:
  • This privacy notice was last updated on Wednesday, May 29, 2024. Site Owner reserves the right to update its privacy policy statement at any time. A notice of any such update containing any material change(s) will be posted on the Site thirty (30) days prior to the implementation of such change.

  • Opt-Out Right:
  • Users have the right at any time to cease permitting personal information to be collected, used, or disclosed by Site Owner and/or by any third parties with whom Site Owner has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Site Owner as described above in paragraph 1(a). After processing the cancellation, Site Owner will delete the user’s information from its database.

Access Rights to Data

  • Information Maintained by ABC:
  • Upon a user’s request, Site owner will provide a reasonable description of customer’s personally identifiable information that Site Owner maintains in its database(s). Site Owner can be contacted using the information provided above in Paragraph 1(a).

  • Corrections and Changes to Personal Information:
  • Help Site Owner to keep user personal information accurate. If a user’s personal information changes, or if a user notes an error upon review of user information that Site Owner has on file, please promptly contact Site Owner.

  • Your California Privacy Rights:
  • Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Site Owner who are California residents to request certain information regarding Site Owner’s disclosure of personal information for their direct marketing purposes. To make such a request, please contact Site Owner in writing using the information provided above in Paragraph 1(a). Within 30 days of receiving such a request, Site Owner will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Site Owner reserves the right not to respond to requests submitted other than to the contact information specified in this paragraph. California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

  • The terms of this privacy notice have been incorporated by references in the Terms of Use for the Site. A user’s acceptance of the Terms of Use is an acceptance of the terms of this privacy notice.
